Wrongful Death Accident in Murfreesboro Leaves Family Searching for Answers

Wrongful death cases are incredibly sad and difficult personal injury cases.  Our role is to provide as much comfort as we can to the family.  But, we also want to honor the victim by holding the responsible parties accountable for what is often an avoidable tragedy.

In March of 2022, the sibling of the deceased victim contacted Weir & Kestner Injury Lawyers through our live chat feature.  Her brother had been killed crossing the street in Murfreesboro, Tennessee.  Her brother was an avid walker.

We ascertained the accident involved the actions of three vehicles.  A criminal investigation was ongoing and certain accident details were hard to come by.  Our job was to figure out the events of that tragic day and hold the proper defendants accountable.

On the day of the accident, the deceased was a pedestrian attempting to safely navigate an intersection.  While crossing the street, he was initially struck by one vehicle, with two additional vehicles being involved.  Out of respect for the deceased and his family we do not think explaining more details are necessary.  It is enough to know that after completing our investigation, we believed two of the three cars had civil liability for the accident.

In wrongful death cases, as with most negligence actions, a defendant can claim comparative fault by the Plaintiff.  This means that a defendant can defend civil liability by alleging that the Plaintiff was some or completely responsible for their own injuries.  We see this defense often in negligence cases, including pedestrian accidents.

One other key component in wrongful death cases is the family needs to have legal standing in order to represent the estate or bring a lawsuit.  So, we provided assistance with the necessary probate filings to set this up.  Once the court approved the documents, our client had the legal standing to represent the estate of the deceased.

Once we had the foundation in place it was time to execute our case strategy, Weir & Kestner Injury Lawyers aggressively pursued the two responsible defendants.  Initially, the insurance companies attempted to fight our case by blaming each other’s insured for the accident.  Undeterred, we kept the pressure on and the insurance companies reversed course.  We obtained policy limits on both vehicles involved in this tragic accident.  Our client accepted the settlements.  In only nine months, following this horrible tragedy, we brought the case to a full resolution.
