$500,000 Mediation Settlement for Client Injured by Delivery Truck Driver
In December of 2024, our client was driving his vehicle on Sam Ridley Parkway in Smyrna, Tennessee, when a delivery truck attempted to change lanes and negligently moved over into Plaintiff’s lane. The delivery truck then collided with our client. Unfortunately, as a direct result of the Defendant’s negligence, the impact of the collision injured our client.

At just 31 years old, our client suffered injuries to his spine, including his thoracic spine. With injuries and ongoing medical treatment, he called Weir & Kestner Injury Lawyers to help him fight against the logistics company’s insurance company. This was a big global delivery company, and he knew he needed help to fight for him.
Weir & Kestner Injury Lawyers immediately began investigating the accident. Liability in this case was straightforward. The Defendant was negligent in the operation of their vehicle by failing to maintain proper control of the vehicle and failure to obey traffic laws. They were also guilty of negligence per se by violating the following statutes in Tennessee:
- Tenn. Code Ann. §55-8-136 – Drivers to Exercise Due Care
- Tenn. Code Ann. §55-8-123 – Improper lane change
- Tenn. Code Ann. §55-8–103 – Required Obedience to Traffic Laws
Weir & Kestner Injury Lawyers aggressively executed a precise litigation strategy and prosecuted the claim to the fullest extent of the law. The case settled in Dec 2025 at a pre-litigation mediation for $500,000. We held this worldwide logistics company accountable for their actions.
